Terms & Conditions

 

Important to Note

The maximum number of guests is three.

Children are welcome.

Sadly we cannot accept pets.

You must be able to climb stairs.

Castle Heights is a top (4th) floor apartment affording it magnificent, unobstructed views of Edinburgh Castle and therefore sadly not suitable to anyone with mobility issues. It is a historic building so there is no elevator but as our reviews testify the views truly make it worth the climb.

Making a Booking

Full payment or a non-refundable deposit of 25% is payable by credit/debit card or Paypal at the time of booking.

If a deposit only is paid at the time of booking the balance payment is due 6 weeks before your arrival date. We will notify you by email when this becomes due.

Bookings made within 6 weeks of the arrival date are payable in full at the time of booking.

If full payment has not been received within 6 weeks of your arrival date, Castle Heights reserves the right to cancel your booking and your deposit will not be refunded.

A completed booking agreed by both parties is a binding contract and any subsequent amendments must be agreed by both parties in writing.

Damage Deposit

At the time of full payment or balance payment we will also request a £100 Damage Deposit to cover any unforeseen small damages. This will be fully refunded upon inspection of the property, under the condition of no damage being found, or the apartment not being left in an excessively dirty or inappropriate state.

Payment Methods

Payment can be made by debit card, credit card or by Paypal via our online booking system. You will not be charged any debit or credit card surcharges.

Booking Confirmation

When you submit a booking via our online booking system you will receive an automatic booking summary via email, and a separate email confirming your card payment. If you have paid a deposit only we will contact you when the balance is due with a link to make the balance of payment. All emails will be sent to the address provided by you in the booking form. Please check all details carefully when you receive each email and contact Castle Heights immediately if you find any discrepancies. All bookings are provisional until payment has been received in full.

Access 

Please note that Castle Heights is located on the 4th floor of a historic building and it has no lifts so sadly is not suitable to guests with limited mobility.



 

Check In and Check Out Times

 

Guests are welcome to check in from 3:00pm. In order that the property can be thoroughly cleaned and prepared for the next arrival, departure time is 10:00am. We ask for your understanding with this.

Collecting your Keys

We have a secure key safe on the outside of the building for collecting your keys. We change the code between each guest and will inform you of your personal code when we send all access information and recommendations out to you upon full payment of your booking.

Care of Property

Guests are asked to keep the property clean and tidy and leave it in such condition at the point of departure. Accommodation left in an excessively dirty or inappropriate state may be subject to extra cleaning and therefore this may be taken out of the Damage Deposit. Heating should be run at the minimum level required, particularly when not present at the property. Accidents happen, we ask that any breakages or damage should be reported immediately to Castle Heights. Failure to do this may result in you being charged for any such breakages or damages. Any missing inventory from the property on your departure may also be charged.

Security

You are responsible for shutting and locking all exterior doors and windows and securing the property when absent or sleeping.

Utilities

Should there be a failure in a utility or service please notify Castle Heights immediately and we will aim to restore the service/utility as quickly as possible however sometimes the failure of a utility/service may be beyond Castle Height’s control.

Candles

Due to the high fire risk the use of candles or tea lights is not permitted in the apartment.

Smoking

Smoking is not permitted anywhere within the apartment or building. If it is evident that guests have been smoking within the apartment Castle Heights reserves the right to charge for any fumigation required. 

Environmental Considerations

Please be mindful that Castle Heights is located within a building containing other apartments with neighbours nearby. We ask that you keep noise levels considerate whilst within the apartment and upon entering and leaving.

We have provided recycling bins for your waste and ask that you separate waste accordingly. You’ll find recycling stations in the Grassmarket itself if you’d like to recycle your bottles. paper and plastics during your stay.

 

Personal Property

Castle Heights will not be held responsible for any loss or damage to any property on the premises. Contents and valuables are left at the owner’s risk. It is recommended that your holiday insurance covers loss or damage to personal effects.

All vehicles are also left at the guests’ risk. Also guests agree to absolve Castle Heights of any responsibility for any accident or mishap to persons or property whilst on the premises, or from any illness or injury arising from any cause whatsoever. 

Parking

We recommend that you arrive by plane or train as you are just a short 5 minute taxi or Uber ride to the apartment from Waverley Train Station. (Or you can walk it in 15 minutes.) Come direct from the airport by tram for a £5 fare and then it is just a short walk, 6 minutes or so. A taxi from the airport takes around 25 minutes. Once here you are within walking distance of everywhere.

 

If you're arriving by car there is a multi-storey NCP car park just 2 or 3 minutes walk away at Kings Stables Road/Castle Terrace. In the Grassmarket itself there are metered bays which are free from 18:30-08:00 and all day Sunday. Outwith these hours you need to pay for these.

Availability

Each booking is made in good faith with the belief that your accommodation will be available to you on the date stated. If for any reason due to circumstances out of Castle Height’s control your accommodation is not available, our liability is limited to the repayment of any rent already paid. You will have no further claim against Castle Heights.

Conditions of Booking 

It is a condition of booking that Castle Heights may only be occupied by the person named in the booking and their named guest(s). Castle Heights may not be sub-let to a third party. If this is found to be the case, the third party will have no legal right of occupancy and will be required to vacate the accommodation immediately.

 

The property is to be used for the purposes of a holiday let to which Section12 (2) and paragraph 8 of Schedule 4 of the Housing (Scotland) Act 1988 apply. The booking agreement confers a right to occupy the accommodation for the agreed period only. 

Extraordinary Circumstances Affecting your Stay

Castle Heights accepts no liability for events prior or during your stay totally beyond our control, eg. destruction of property due to flood, fire, earthquake or acts of nature; or if the property becomes uninhabitable due to irreparable damage or on Health and Safety issues that could not reasonably have been foreseen. In such cases refunds will be at the discretion of Castle Heights.

Review of Terms and Conditions

Castle Heights reserves the right to change or amend these Terms and Conditions at any time.

Special Disclaimer

You acknowledge the contagious nature of the Coronavirus/COVID-19, or other similar pandemic viruses, (the “Virus”) and that many public health authorities recommend social distancing.    

Whilst we have put in place preventative measures to reduce the spread of any such virus, you acknowledge that we cannot guarantee that you will not become infected with the Virus. You understand that the risk of becoming exposed to and/or infected by the Virus may result from the actions, omissions, or negligence of yourself and others, including, but not limited to, our staff, and other guests and their families.

You voluntarily seek the accommodation services we provide and acknowledge that you are increasing your risk of exposure to the Virus. You acknowledge that you must comply with all set procedures to reduce the spread while staying with Us.

You attest that:

  • You are not experiencing any symptom of illness such as cough, shortness of breath or difficulty breathing, fever, chills, repeated shaking with chills, muscle pain, headache, sore throat, or loss of taste or smell.

  • You have not travelled to a highly impacted area in the last 14 days.

  • You do not believe you have been exposed to someone with a suspected and/or confirmed case of the Virus.

  • Either you have not been diagnosed with the Virus or you have been cleared as non-contagious by your local public health authority.

  • You are following all recommended guidelines as much as possible and limiting your exposure to the Virus.

You hereby agree and release us harmless from, and waive on behalf of yourself, your heirs, and any personal representatives, any and all causes of action, claims, demands, damages, costs, expenses and compensation for damage or loss to yourself and/or your property that may be caused by any act, or our failure to act, or that may otherwise arise in any way in connection with any services received from Us. You understand that this release discharges us from any liability or claim that you, your heirs, or any personal representatives may have against us with respect to any bodily injury, illness, death, medical treatment, or property damage that may arise from, or in connection to, any services received from us. This liability waiver and release extends to us together with all owners, partners, and employees.
